General Terms and Conditions:

Accommodation

a. The promo is available for direct bookings only. Advance booking or booking at least twenty-four (24) hours prior to arrival to the resort is required.

b. Rates are inclusive of the following:

• Complimentary pick-up and drop-off to Bicol International airport or Hotel St. Ellis;
• Complimentary refreshment upon arrival;
• Overnight accommodation for two (2) persons;
• Complimentary breakfast for two (2) persons;
• Complimentary use of non-motorized water activities (kayak and stand-up paddle);
• Value Added Tax and Service Charge.

c. Standard allowable occupancies apply.

d. Extra person charge of PHP 3,700 per room, per night applies, if with no bed set up, inclusive of breakfast and other package inclusions.

e. Extra person charge of PHP 4,100 per room, per night applies, if with bed set up, inclusive of breakfast and other package inclusions.

f. Kids below eleven (11) years old and below are free of charge if bed sharing with adults. Maximum of two (2) kids only are allowed per room.

g. Corkage fees shall apply to outside food brought in.

h. Cardholders can book a maximum of five (5) rooms only per booking.

i. The offer is not applicable for extensions of stay.

j. Any booking modifications made within seven (7) days or less prior to expected arrival will be charged with a modification fee equivalent to 20% of the total reservation amount. New stay dates are subject to availability and should be within the Stay Period. If new stay date is outside of the Stay Period or if change in stay date is done outside of booking period, the foregoing offer will no longer apply.

k. Cancellations made within fifteen (15) days or less prior to expected arrival are subject to a cancellation fee equivalent to 30% of the total reservation amount.

l. Cardholders must be present during check-in and must present the Metrobank card used in booking and his/her valid government-issued ID. In case that the guest is not the Metrobank cardholder, a copy of the written authorization letter, Metrobank card used and government-issued ID of the cardholder must be presented.

m. Should the cardholder or guest fail to present the documents required, the promo or discount will not apply, and the applicable rate without the discount will apply, and all the room inclusions under the promo will be forfeited.

Day Tour

a. Rate is inclusive of resort entrance fee, welcome drinks, lunch, use of infinity pool and beach towel.

b. Day tours are from 8 am to 5 pm only.

c. Day tour package can be booked through e-mail or call reservation only.

d. Book at least 24 hours before arrival. Walk-ins are not allowed.

e. Pets are not allowed.

Dining

a. Applicable for dine-in transactions only.

b. Promo is valid for check-in and day tour guests.

c. Discount is applicable to total food and drinks bill only. Service Charge and Value-Added Tax (VAT) are not included in the discount, and shall be charged based on the original price.

d. Promo is not applicable in private dining packages.

Spa

a. Applicable for non-package massage only.

b. Promo is valid for check-in and day tour guests.

c. Reservation is encouraged.

Other Terms and Conditions:

a. Metrobank cardholders must charge the total amount to their qualified Metrobank card through Misibis Bay’s Point-Of-Sale terminal or official payment link provided.

b. Only one (1) qualified card will be accepted per cardholder, per transaction, even if he or she has more than one (1) qualified Metrobank card.

c. Splitting of transactions is not allowed. Splitting of transactions is defined as an intentional act of dividing a merchant transaction into multiple charge slips to redeem more than one reward incentive. A presumption of splitting of transactions arises when there are two (2) or more transactions in one merchant outlet or establishment over one and the same product, and the interval of these transactions were made within 5-10 minutes.

d. The promo is non-transferable, non-cumulative, cannot be exchanged for cash or other products.

e. The promo is not valid in conjunction with other promos of Metrobank and Misibis Bay.

f. In the purchase of goods and services in connection with this promo, senior citizens or persons with disability (PWD) can either avail of the promo or the discount provided under the Expanded Senior Citizens Act 2010 or Magna Carta for Persons with Disability, whichever is higher, if applicable.

g. The use of the Metrobank Cards in connection with this promo is subject to the Terms and Conditions governing the issuance and use of Metrobank Cards. In such a dispute, Misibis Bay shall have no liability.

h. Metrobank reserves the right to disqualify a previously approved transaction subsequently cancelled or charged back within the promo period. Should a cardholder receive the discount, but was later on deemed unqualified for not meeting the requirements of the promo due to disputes arising from, but not limited to, erroneous, invalid, fraudulent or unauthorized transactions, the cost of the discount shall be charged by Metrobank to the cardholder’s card account.

i. Any amendment in the terms and conditions is subject to DTI approval.

j. The terms and conditions governing the issuance and use of Metrobank Cards, reminders and other provisions contained in the card carrier, statement of account, charge slips and other documents or instruments, which are made an integral part hereof by reference, shall likewise be resorted to in instances where they are applicable in this promo.

k. Any dispute concerning the products or services, including pricing, related to the promo shall be settled directly between the cardholder and Misibis Bay, with the concurrence of the DTI. Metrobank shall be free from any liability in the event of such dispute.

l. In case of dispute in respect of Metrobank only and the cardholder’s availment of the promo, the decision of Metrobank, with the concurrence of the DTI, shall be considered final.

m. By joining or availing of this promo, the cardholder confirms that he/she has read, understood and agreed to the promo mechanics and its terms & conditions.
